My 17 year old son was driving his 2003 Ford Explorer, when he was hit by another vehicle. My son was approaching a stop light and traveling between 3-5 mph....The vehicle that struck him was a company work vehicle. The work truck was pulling out of a parking lot when he hit my son. His estimated speed was also 3-5 mph. There were no injuries at all, and there was no medical treatment sought. This all happened on April 10th 2011. It was found that driver of the work truck was at fault for inattention. Honestly, this guy was super nice and walked my son through the process of calling police etc til I could get there....Now dealing with the Companies insurance carrier has been a headache!!!! here is the basic timeline....Explorer still drivable....Had to wait 10 days for police report....contacted Company that owned work truck, and they forwarded me to their insurance co....Was advised to seek several estimates, and fax them over....Faxed over estimates to adjuster. All estimates exceeded 5k....Stated she would have to contact an adjuster from local area to work this. Local adjuster came out. Estimated damages to be 3300.00. Insurance Company sent me check for 3300.00 and advised me when vehicle repaired, auto shop would need to work with adjuster on any additional repairs and costs. Explorer was in shop 30 days before finally being totaled. Local adjuster was horrible to work with, did not communicate with body shop, etc. I finally contacted the insurance company, and told them I refused to deal wither contracted adjuster etc. Now that the vehicle has been totaled, they don't want to pay what I think is fair. The insurance company wants to settle for $6928 plus $367 for taxes. Clean retail for the Explorer is $8100. This is for my area. I have been car shopping for 2 days straight. can't find anything comparable with the money they gave me etc. I have taken off work to deal with this etc, been going on for 2 months plus, and Iam worn out with it all...All I want is for my kid to be back in a safe reliable vehicle. The insurance company did provide a rental car. I've just been obtaining quotes for a couple of cars I may buy - I'm 19 and looking to buy my first car. I was on moneysupermarket.com and noticed Admiral were consistently the cheapest company - so I kept changing some details to make the quote lower if possible, just messing around really. After around 10 quotes or so (with them being the lowest each time) I noticed that admiral was no longer displaying a quote and was now in the section shown as no quotes produced along with around 60 other companies. Why is this? Have I broken a limit of some kind? But why would the other companies still be there displaying quotes (albeit they're higher which isn't to my liking!). Long story short (hopefully)...My 17 yr old step-son got his license just after his b-day last yr and my husband stupidly bought him an undeserved car (we have had nonstop issues with him for over 2 yrs with his disrespectful and insulting/criticizing attitude, refusing to follow house rules, his very poor, negative and selfish behavior on top of his constant lies and his drug and alcohol use and continues to bring it around my 4 yr old son). Needless to say after receiving 4 tickets under 6 months for either having too many kids in car or driving past allowed hours to be driving because he refuses to follow our rules or the law and feel they do not apply to him. He completely trashed the car, it reeked of cigarettes and pot, we found empty beer cans and other cans used to smoke his pot. We took the car away and cleaned it the best we could and after a few months of him still continuing his behavior and habits we sold the car. He bullies his mom and sister (always has) and took his moms keys and her car from her and will not return it. I know we are legally responsible for him until he turns 18 which isn't too much longer BUT he is getting worse with everything, my husband has given up on him and just lets him come and go as he pleases and do what he wants (he claims he will kick him out on his bday but no one believes him b/c of many past threats not followed through and his kids know it so they continue to play him), I'm told to stay out of it because he isn't my son yet he is still on MY insurance and driving his mom's car while drinking and smoking pot and continuing not to follow the law with his restrictions either. I can't wait for this ungrateful punk to be out of my house. He constantly badmouths all of us with lies to everyone and blames us when things don't go his way. He has always been extremely lazy and does not want to work, he keeps forcing his mom to give him money which she does b/c she claims she is afraid of him, he has NEVER helped with anything around the house, he has already been in trouble a few times with the police as young as 12 when he wouldn't follow skateboarding rules. This kid needs a major attitude adjustment and a kick in the *** but no one will do it and I'm not allowed to say anything to him about anything but I'm so sick and tired of having to keep my mouth shut and watch everything he says and does to his family yet I am to provide insurance for this a@%hole. He's not supposed to be driving anyone's car but he took his mom's and won't give it back to her, he lives with us even though he is NEVER here (DYFS took the kids away from their mom about 4 yrs ago and placed them with us immediately) (oh, the issues have been going on a lot longer than these 4 yrs but not to this degree). By the time we file and the court allowed for emancipation he will be 18 so that is no use. He HAS to live with us until then but I don't want my insurance going up anymore than it has and want him off of it. He refuses to hand over his license too. I am at my wits end with this kid and don't know what else to do. Does anyone have any ideas on any loopholes on how to get him off my insurance? If we force him to stay here he gets violent toward everyone, constantly picks fights with all of us, storms around the house cursing and complaining, slamming everything, purposely makes messes and leaves it until he gets his way and I definitely do not want that behavior around my son. My husband has told him he is no longer a part of our family and it doesn't faze him at all and he just does not care about anyone but himself. Please no criticizing me. I have been his step-mom for almost 10 yrs now and have never been allowed to discipline my husband's kids at all and always told to not get involved in anything b/c they are not my kids yet they both walk all over their dad (and their mom), are spoiled rotten, no responsibilities or chores at all and never any consequences when they do something wrong. For those of you who actually read all of this thank you. Yes, I am venting but really need it and this still is not the whole story but it's too much to go into.

Car insurance claim failed. I am totally innocent and will not give up. Where do I stand with this?

The accident happened on a roundabout I was already on, someone pulled out on me and I T-boned the side of their car. An 'independent' assessor has looked at my car and wrote a damage report which went to the other drivers insurance company (who I am personally claiming from as my insurance is 3rd party cover only). Their company have now wrote to me saying they are denying my claim because: They can't understand why the whole front of the car is damaged (erm..because I T-boned the other car!) They can't understand why the nearside wing is damaged (erm..because she kept driving for a few seconds, which tried to drag my car to one side. The chassis went out of line and it moved the wing out of position). They can't understand how the nearside door is damaged (erm..it isn't!). Is there much else I can do other than write to argue their statement? A solicitor or small-claims court would not be cost effective as I'm only claiming approx 400. What can I do?

I know they'll cover the cost of the broken window ($200, already dropped it off to get fixed), but my dad (owner and insurance payer of the car) is wondering if the increase in rates will be worth saving the $200 in window repair.
